Acceptable Usage Policy
HostAvenueT provides web hosting services to clients and thus has a responsibility to protect each client and to provide the best service possible. The following guidelines were designed to insure these services.

Content
All services provided by HostAvenueT may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secrets and other statues. The subscriber agrees to indemnify and hold harmless HostAvenueT from any claims resulting from the use of the service that damages the subscriber or any other party.

NOTE: Pornography and sex-related merchandising are prohibited. This includes sites that may infer sexual content, or links to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to our servers or any other server on the Internet. Links to such materials are also prohibited.

HostAvenueT will be the sole arbiter as to what constitutes a violation of
this provision.

Server Resource
Any website that uses a high amount of server resources (such as, but not limited to CPU time) will be given an option of either paying extra (which depends on the resource needed) or reducing the resource needed to an acceptable level. HostAvenueT shall be the sole arbiter of what is considered to be a high server usage level.

CGi Scripts
Cgi script sharing with domains not hosted by HostAvenue.com is not allowed.  Any cgi-script deemed to be adversely affecting the server performance or the network integrity will be shut down without prior notice.

Chat Rooms
HostAvenueT does not allow clients to install their own chat rooms. Chat rooms tend to be large system hogs and we cannot permit it as an account option. HostAvenueT does provide a choice of Java chatrooms for a small extra charge that should meet most users' needs and run without hindering the performance of the machine of our servers.

Background Running Programs
HostAvenueT may allow programs to run continually in the background , these programs will be considered on an individual basis and extra charge will be incurred based on system resources used and operational maintenance needed. If you wish to run background programs please contact us at support@HostAvenue.com before doing so.

IRC
HostAvenueT does not allow IRC or IRC bots to be operated on our servers.

Commercial Advertising - Email
Spamming, or the sending of mass unsolicited email, from a HostAvenueT server or using an email address that is maintained on a HostAvenueT machine is STRICTLY prohibited. HostAvenueT will be the sole arbiter as to what constitutes a violation of this provision.

Server abuse
Any attempts to undermine or cause harm to a HostAvenueT server or customer of HostAvenueT is strictly prohibited.  Any sub-networks of HostAvenueT and dedicated servers must adhere to the above policies. The failure to meet or follow any of the above guidelines are grounds for account deactivation. We reserve the right to remove any account without prior notice.

Software Distribution
HostAvenue.com Web Hosting accounts are not to be used for the purposes of distributing software products.  If you wish to distribute software, please contact sales@HostAvenue.com for special arrangement.

Multimedia Files
Multimedia files are defined as any graphics, audio, and video files. HostAvenue.com Web Hosting accounts are not to be used for the purposes of distributing and storing unusual amount of multimedia files.  Any Web site whose disk space usage for storing the multimedia files exceed 70% of its total usage, either in terms of total size or number of files, will be deemed to be using unusual amount of multimedia files.

Database
Any database stored on HostAvenue.com servers shall be be limited in size to 10% of the total disk space allotted for a particular domain.

Billing Periods
HostAvenueT bills on a monthly, quarterly or yearly cycle, depending on what option and plan has been selected. Account and billing anniversary information will be sent to you after we have received your order. Prompt payment is necessary to ensure uninterrupted service of your account. For credit card customers, you will be charged the appropriate amount at the beginning of your account's billing period. For check/money order customers, HostAvenueT must receive your check/money order by the beginning of your billing period. NOTE: HostAvenueT charges a $45.00 fee for returned checks. For international customers, if you are sending a check/money order the amount must be drawn in US dollars.

Refund Policy
Our Silver, Gold, Platinum and CommercePac plans include a 30 day money back guarantee. If you are dissatisfied with your service for any reason, you will receive a full refund (minus setup fees and overage charges) if you cancel your account within 30 days of the activation of your account. Our refund policy does not apply to any additional items or services; this includes but is not limited to POP accounts, Real Audio/Video and mSQL. No refunds are available after 30 days. Any request for cancellation must be received via the Web form, regular mail or fax. Cancellations over the telephone and email are not accepted. For customers who have purchased a quarterly or yearly plan and wish to cancel their account before the end of their plan HostAvenueT will refund the balance (this does not include setup fee, overage charges and additional item charges) of your account, however, HostAvenueT will charge based on the full monthly rate for services rendered.
